She'd still have received a warning (and rightly so) for gesturing to spit at him, it's serious enough an action.
I believe this is what she did also and she apologised because she was warned.
I can't believe people are comparing this to the Dennis incident either. Dennis leant over and directly spat in someone's face, and then spent the next few hours continuing to mock and goad them for it. Janice made a gesture, and as offensive as it still is, it's nowhere near on the scale of the Dennis incident. From what I saw she also gestured towards his body and not his face so had any saliva actually left her mouth I don't think that's as serious as the face either. All are worthy of very serious final warnings but only intentionally spitting in someone's face is grounds for a removal IMO.
