Socialite Paris Hilton is so "emotionally distraught and traumatised" since being sentenced to 45 days in jail, she cannot attend a civil trial which was set to start next Monday.

Psychiatrist Dr Charles Sophy has filed a legal declaration in which he claims Hilton is "not capable of any meaningful participation" in the civil case brought against her by diamond heiress Zach Graff.

Graff has launched her $10m (€7.4m) suit against Hilton because of the "vicious lies" the hotel heiress spread about her that ended up being printed in the New York Post newspaper.

However, Sophy writes that Hilton's state of mind after being found guilty of violating her probation by driving with a suspended license means she "cannot effectively respond to examination as a witness or provide any significant input into her defence."

The judge has postponed the trial until 22 August, reports website TMZ.com.

Exactly. It's all very well claiming she's traumatised. Imagine if she was a member of the public who said they were too traumatised to appear at their own trial.

I'm highly sceptical of all this - I can't help thinking that Paris is doing as much as she can to remain in the media, and in fact, this business is just helping her.

Oh come on....... like Ruth said....no ordinary person would get away with this.

I am sorry but she drove on a suspended licence. Plain and simple!

It just goes to show you how much she is wiling to milk this for all its worth

No publicity is bad publicity if handled properly.

Paris Hilton's delicate state of mind is keeping her out of the courtroom ... for now.

According to a declaration filed by Dr. Charles Sophy, a psychiatrist who has seen Paris "off and on" over the last six months, Hilton is "not capable of any meaningful participation" in a civil trial brought against her by diamond heiress Zeta Graff. In a $10 million lawsuit filed in 2005, Graff claims that Hilton spread "vicious lies" about her that were printed in the New York Post.

Paris' shrink claims that Hilton is "emotionally distraught and traumatized" from the May 4 hearing where she was sentenced to 45 days in jail for breaking probation in her DUI bust, and asked a judge to allow her sufficient time to recover. In the document, the head-doc goes on to explain that Hilton "Cannot effectively respond to examination as a witness or provide any significant input into her defense." In fact, Sophy claims that forcing Paris to participate on May 21 would "exacerbate her current mental condition." The horror!

As a result, the judge has postponed the trial date until August 22.

Calls to Hilton's rep were not immediately returned.

She's traumatised because she got caught doing the wrong thing, and expected special treatment, which she didn't get. Boo-hoo. She needs to get over herself and grow up.

Its not secret that I don't really rate Paris Hilton...But she broke the law so why should she get away with it?? No other 'Normal' person would have!
